The Three Insurance Phases of Every Uber & Lyft Claim

Utah law (the Transportation Network Company Act, Utah Code § 13-51) requires rideshare coverage in tiers, and Uber’s and Lyft’s policies track them:

Phase 1 — App OFF

The driver is just a private driver. Only their personal auto policy applies — and personal policies are
usually small.

Phase 2 — App ON, waiting for a ride request

Contingent coverage applies: at least $50,000 per person / $100,000 per accident in bodily injury coverage and $25,000 in property damage. Here’s the trap: the driver’s personal policy typically excludes commercial activity, so this middle tier is often the only coverage, and insurers on both sides love to point fingers at each other.

Phase 3 — Ride accepted, en route, or carrying a passenger

$1,000,000 in liability coverage applies, generally including uninsured/underinsured motorist coverage that protects passengers even when some other driver caused the crash.

The phase determines the money. The money determines how hard the insurance companies fight. Proving the phase, through app data, trip records, and receipts, is step one of every rideshare case.

Who Can Bring a Utah Rideshare Injury Claim?

Almost anyone hurt in a crash involving a rideshare vehicle:

  • Rideshare passengers — the cleanest claims; you’re nearly never at fault, and Phase 3’s $1M policy is in play
  • Drivers and passengers of other vehicles hit by an Uber or Lyft driver
  • Pedestrians and cyclists struck by a rideshare vehicle
  • Rideshare drivers themselves, when another driver caused the crash

Each position involves different policies, thresholds, and tactics. The common thread: rideshare claims involve corporate-grade insurers behind a consumer-friendly app logo.

Why Uber and Lyft Aren’t Automatically Responsible

Uber and Lyft classify drivers as independent contractors, not employees — which lets the companies argue they aren’t legally responsible for a driver’s negligence the way an employer would be.

That’s why the tiered insurance exists, and it’s usually where recovery comes from. But in some cases the companies face direct liability — for example, when they kept a driver on the platform despite disqualifying driving history or prior complaints (negligent retention), or when their background check process failed. We look at both paths in every case.

Utah’s No-Fault Rules Still Apply

Rideshare crashes still run through Utah’s no-fault system:

  • Your own PIP coverage (minimum $3,000) pays your first medical bills — and as a rideshare passenger without your own auto policy, PIP coverage on the vehicle protects you
  • To pursue the at-fault party for full damages, you must cross Utah’s tort threshold (Utah Code § 31A-22-309): more than $3,000 in medical expenses, or an injury involving death, dismemberment, permanent disability or impairment, or permanent disfigurement
  • Utah’s comparative negligence rule applies — you can recover if you were less than 50% at fault

This is where rideshare cases get genuinely complicated: PIP, a personal auto policy, a contingent corporate policy, a $1M policy, and possibly your own UM/UIM coverage can all be in play at the same time. Sequencing them correctly is the difference between a full recovery and leaving money on the table.

What to Do After an Uber or Lyft Accident in Utah

  • Call 911 and make sure a police report is filed — insist on it, even for a “minor” crash
  • Screenshot everything in the app: the trip screen, driver name, route, receipt. This is your proof of the insurance phase, and it can disappear from your view
  • Report the crash through the app (Uber and Lyft both have in-app accident reporting)
  • Photograph vehicles, scene, and injuries; collect witness contacts
  • Get medical care right away — and keep going until your doctors release you
  • Don’t give recorded statements to any insurer (there may be three or four involved) before speaking with a lawyer

I was a passenger in an Uber that crashed. Who pays my medical bills?

Your medical bills start with PIP coverage, then flow to the liable party’s insurance — usually the $1M Phase 3 policy if your driver was at fault, or the other driver’s policy (plus Uber’s UM/UIM coverage if they’re uninsured or underinsured). Passengers are rarely at fault, which makes these strong claims — but the paperwork is anything but simple.

Can I sue Uber or Lyft directly?

Usually the claim runs against the tiered insurance policies rather than the company itself, because drivers are independent contractors. Direct claims against the company are possible in specific situations, such as negligent retention of a dangerous driver or background check failures, and we evaluate that in every case.

What if the Uber driver wasn't logged into the app?

Then it’s treated as an ordinary car accident against the driver’s personal auto policy. Proving app status matters enormously — which is why we obtain trip data and driving logs early, before accounts are deactivated or records become hard to reach.
